Terms & Conditions
These terms and conditions govern the provision of services by Arsoft1 Ltd to the Client. By accepting a proposal or SOW, the Client agrees to be bound by these terms.
2.1. Project Scope and Change Requests
Agreement: All projects are executed based on the scope defined in the agreed-upon Proposal or Statement of Work (SOW).
Changes: Any request by the Client to change the scope of work after project initiation must be submitted in writing. The Company reserves the right to re-quote the project cost and adjust the delivery timeline for any significant scope change.
2.2. Intellectual Property (IP) and Design Ownership
Client Ownership: Upon full and final payment for a project, the Client will receive all final, core files and will own 100% of the Intellectual Property Rights for the finalised design, developed website, or custom software solution.
Unfinalised Work: The Client shall not own or retain any rights to concepts, materials, media, or other content generated during any phase of revision or that does not form part of the Final Delivered Product.
Refunds: In the event of a full refund, all ownership rights to any submitted design concepts or work revert immediately and solely to Arsoft1 Ltd. The Client will have no right to use the designs for any purpose.
2.3. Client Responsibilities (Content and Information)
The Client is responsible for providing all required content (text, images, products, data) necessary for the project in a timely manner as outlined in the project schedule.
The Company is not responsible for creating or populating content unless this service is explicitly purchased and detailed in the SOW.
Delays caused by the Client's failure to provide necessary information or content on time may result in delays to the project schedule.
2.4. Technical Support and Hosting
The Company's primary role is design, development, and digital marketing. Technical support for third-party services (e.g., purchased hosting, domains, SSL certificates, email installation) is not included unless an ongoing maintenance or support package is explicitly purchased.
If a website is hosted on a server purchased by the Client from a third party, the Company is not responsible for any server-related issues, outages, or technical troubleshooting beyond the scope of the development work.
2.5. Communication
All formal requests, including feedback, revision requests, and refund claims, must be submitted in writing via the Company's official email address. The Company is not responsible for issues or delays resulting from communication through unapproved channels.
Delivery Policy (Turnaround Time)
3.1. Turnaround Time Definition
The standard turnaround time for a single design or revision iteration is 48 to 72 hours (two to three working days), unless otherwise specified in the SOW.
This turnaround time applies only to the time taken for a single stage or revision; it does not represent the total duration from the start to the completion of the entire project.
3.2. Examples
Project submission or revision requested on a Monday will typically be delivered by Wednesday.
Project submission or revision requested on a Friday will typically be delivered by the end of the following Tuesday.
3.3. Project Finalization
Websites will only be deployed live or final files released once all outstanding invoices and dues have been cleared by the Client.
